1) Scope of Application
1.1 These General Terms and Conditions (hereinafter referred to as "T&Cs") apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter referred to as "Customer") concludes with Soleil D'Or (hereinafter referred to as "Seller") via its online shop. Deviating terms and conditions of the Customer will not be accepted unless the Seller expressly agrees to their applicability.
1.2 A consumer within the meaning of these T&Cs is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or self-employed profession.
1.3 An entrepreneur within the meaning of these T&Cs is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, is acting in the exercise of their trade, business, or self-employed profession.
2) Conclusion of Contract
2.1 The product descriptions on the Seller's online shop do not constitute binding offers but serve as an invitation for the Customer to make a binding offer.
2.2 The Customer makes an offer by placing the desired goods in the virtual shopping cart, completing the online ordering process, and clicking the final order button.
2.3 The Seller may accept the Customer's offer within five days by:
- sending a written order confirmation or an order confirmation in text form (e.g., email),
- delivering the ordered goods, or
- requesting payment from the Customer.
The acceptance period begins the day after the Customer submits the offer and ends after the fifth day. If the Seller does not accept the offer within the specified period, the offer is considered rejected.
2.4 If the Customer chooses PayPal or Amazon Payments as a payment method, the Seller accepts the offer upon completion of the payment process.
2.5 After the contract has been concluded, the Seller stores the contract text and makes it available to the Customer in text form (e.g., via email).
2.6 The contract can be concluded in German and English.
2.7 Order processing is usually done via email. The Customer is obliged to ensure that their email address is correct and that emails from the Seller can be received.
3) Right of Withdrawal
3.1 Consumers have the right to withdraw from the contract.
3.2 Details of the right of withdrawal are set out in the Seller’s withdrawal instructions.
4) Prices and Payment Terms
4.1 The prices stated include the statutory value-added tax. Additional shipping costs will be specified separately.
4.2 For deliveries to countries outside the European Union, additional costs (e.g., customs duties, transfer fees) may arise, which the Customer must bear.
4.3 The available payment methods will be displayed in the Seller's online shop.
4.4 If prepayment is agreed, payment is due immediately after the conclusion of the contract.
4.5 When using payment services such as PayPal, SOFORT, or credit card providers, their specific terms and conditions apply, which are referenced in the online shop.
5) Delivery and Shipping Terms
Important: Dear Customers,
Due to the current high demand for our products, delivery times may unfortunately be delayed. We are doing our best to process and ship your order as quickly as possible. However, delivery may currently take up to 14 days. We kindly ask for your understanding. Thank you for your patience and trust.
Standard shipping with DHL after the shipping confirmation with tracking number within Germany may currently take 1-3 business days due to high demand (excluding public holidays).
After your order is shipped, you will receive a tracking number. With this number, you can track the status of your shipment online at: DHL Tracking.
5.1 Delivery is made to the address specified in the order process.
5.2 If delivery is not possible due to reasons attributable to the Customer, the Customer will bear the additional costs incurred.
5.3 The risk of accidental loss or damage to the goods passes to entrepreneurs upon handover to the carrier, and to consumers upon delivery to the Customer.
5.4 The Seller reserves the right to withdraw from the contract if the goods are unavailable. The Customer will be informed immediately, and any payments already made will be refunded.
5.5 If the goods are to be collected in person, the Customer will be notified by the Seller when the goods are ready for pickup.
6) Retention of Title
The Seller retains ownership of the delivered goods until full payment has been made.
7) Defects Liability (Warranty)
7.1 The statutory warranty rights apply, unless otherwise specified below.
7.2 For entrepreneurs, the following applies:
- The limitation period for defects in new goods is one year from delivery.
- For used goods, warranty claims are excluded.
7.3 The above limitations of liability do not apply to damages caused by the Seller’s gross negligence or intent.
8) Special Terms for Processing Goods According to Customer Specifications
8.1 The Customer ensures that any content provided does not infringe the rights of third parties.
8.2 The Customer indemnifies the Seller against claims by third parties arising from the violation of rights due to the content provided.
8.3 The Seller reserves the right to reject processing orders if the content provided violates applicable law.
9) Special Terms for Repair Services
9.1 Repairs are carried out at the Seller’s location, unless otherwise agreed.
9.2 The Customer is responsible for sending the goods to be repaired to the Seller at their own cost and risk.
10) Redemption of Promotional Vouchers
10.1 Promotional vouchers can only be redeemed within the specified period and before completing the order process.
10.2 A refund of remaining amounts is not possible.
10.3 Vouchers are non-transferable.
11) Applicable Law
The law of the Federal Republic of Germany applies. For consumers, this choice of law only applies to the extent that it does not conflict with mandatory provisions of the country of residence.
12) Alternative Dispute Resolution
12.1 The EU Commission provides a platform for online dispute resolution under https://ec.europa.eu/consumers/odr.
12.2 The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
